In short

  • Pushix is a business tool for sending push notifications to people who have agreed to receive them.
  • You own your data and your subscribers. We process them only to run the service for you.
  • When a plan limit is reached, sending, in-app messages and new sign-ups of subscribers stop until you upgrade; your existing subscribers are never deleted.
  • Do not send spam, scams or unlawful content. We can pause or suspend accounts that do.
  • Indian law applies. The full terms below are what count; this box is only a summary.

1. About these Terms#

These Terms of Service (“Terms”) are an agreement between you and Pushix (“we”, “us”, “our”) about Pushix, the push-notification service available at pushix.in, together with its dashboard, REST API, software development kits (SDKs) and WordPress plugin (together, the “Service”).

You accept these Terms when you create an account, accept an invitation to join an organization, or use the Service in any other way, including through the API or an SDK. They include the policies they refer to: the Privacy Policy, Acceptable Use Policy, Data Processing Addendum, Cookie Policy, Refund & Cancellation Policy and Service Delivery Policy. If you do not agree, do not use the Service.

The Service is meant for businesses, developers and other professional users. You must be at least 18 years old and able to enter into a binding contract. If you use the Service for a company or other organization, you confirm that you may accept these Terms on its behalf, and “you” then means that organization as well.

These Terms apply from the date shown as “Last updated” at the top of this page. They are an electronic record under the Information Technology Act, 2000 and the rules made under it, and do not need a physical or digital signature. They are published in line with rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (the “IT Rules”).

2. Words we use#

Organization
The workspace that owns apps, has a plan and has team members. Every new account starts with one.
Team member
A person with access to an organization, as an owner (full control, including the plan, the team and deletion), an admin (apps, API keys and the team) or a member (messages and audience).
App
An Android or iOS app or a website that you connect to Pushix. Each has an App ID and a REST API key.
Subscriber
A phone, tablet or browser registered with one of your apps through our SDKs or API.
Customer Data
Everything you or your apps submit to the Service: subscriber records and tags, notification and in-app message content, templates, segments, automations, and the delivery credentials you upload.

3. Your account and organization#

  1. Accurate details. Sign up with your real name and an email address you control, and keep them up to date. We may ask you to confirm your email address (the link we send is valid for three days) before you can use the dashboard fully.
  2. Your team. The owner of an organization decides who joins it and with which role, and is responsible for everything done in the organization, by its team members and with its API keys.
  3. Keep access secret. Keep your password and REST API keys confidential. Use REST API keys only on your servers, never in an app or web page. If you think a key or password has been exposed, rotate the key in the dashboard, change the password and tell us straight away.
  4. One account per person. Do not share accounts, and do not create extra accounts or organizations to get around plan limits.
  5. Sign-ups. We may decline a sign-up, or stop accepting new sign-ups, at any time.

4. Your apps, subscribers and consent#

You decide whom you send notifications to and what they say. In particular, you are responsible for:

  • getting each subscriber’s permission through the operating system or browser prompt, and any further consent the law requires (for example before sending marketing messages);
  • telling your users, in your own privacy notice, that you use a service provider to send notifications and what data your app or website shares with it;
  • giving subscribers an easy way to stop receiving notifications, and respecting that choice;
  • the content of every notification, in-app message, template and automation you create, schedule or send through the API;
  • having a lawful basis for any data you attach to subscribers, such as tags, external user IDs or purchase amounts; and
  • following the rules of Apple, Google and browser makers that apply to your apps and websites.

Notifications to Android and iOS apps are delivered through Firebase Cloud Messaging using credentials from your own Firebase project. Your use of Firebase, and of Apple’s push service, is governed by your own agreements with Google and Apple. We keep these credentials encrypted and use them only to deliver your notifications.

For your subscribers’ personal data, you are the controller (a “data fiduciary” under Indian law) and we act as your processor, as set out in the Data Processing Addendum.

5. Plans, limits and fair use#

Every organization has a plan. The free plan and each paid plan include limits — such as the number of apps and websites, subscribers, notifications per month and team members, and which features are included — as shown on our pricing page and on the usage page of your dashboard.

When you reach a limit

  • You cannot add more apps or invite more team members until you are back within the limit.
  • If your organization has more subscribers than the plan includes, the Service stops — sending of all kinds, in-app messages and new subscribers — until you remove subscribers or move to a bigger plan.
  • If your organization has used all the notifications its plan includes for the month, the Service stops in the same way until the next calendar month or until you move to a bigger plan.
  • Messages to test devices still go out, so you can check your setup.
  • While a limit is exceeded, no new subscribers are added, but we never delete your existing subscribers because of a plan limit. Scheduled, automated and queued messages that fall due while the service is stopped are not sent, and are not sent later either.

Fair use

To protect the Service and the delivery services it relies on, we may queue, slow down or rate-limit sending and API requests, and set reasonable technical limits that apply to everyone on a plan. You must not try to get around them.

Changes to the free plan

We may change what the free plan includes. If a change reduces what you can use, we will tell you by email or in the dashboard at least 30 days before it takes effect.

6. Paid plans and payment#

  1. Prices. Paid plans are priced in Indian rupees (INR), per month or per year, and are paid in advance. The prices on our pricing page apply unless we agree a different price with you in writing.
  2. How to pay. Until online checkout is available, paid plans are arranged with our team: we confirm the plan, the price and how to pay in writing before you pay. When online payments are available, they are processed by a payment gateway authorised by the Reserve Bank of India. We do not receive or store your full card number, CVV, UPI PIN or net-banking password.
  3. Renewal. If you set up a recurring payment (such as a card or UPI mandate), your plan renews automatically for the same period until you cancel, and you will receive any notice before each charge that your bank or payment provider requires. Otherwise your plan ends at the end of the period you paid for and your organization moves to the free plan.
  4. Taxes. Any taxes that apply are shown before you pay and on your receipt.
  5. Invoices. We send an invoice or receipt for every payment to the email address of the organization’s owner.
  6. Price changes. We will tell you at least 30 days before a price change affects you. New prices apply from your next renewal, and you can cancel before then.
  7. Missed payments. If a payment fails and is not made within 7 days of our reminder, we may move the organization to the free plan. We do not delete Customer Data because of a missed payment.
  8. Refunds and cancellation are covered by our Refund & Cancellation Policy. When and how paid plans are activated is covered by our Service Delivery Policy.

7. Acceptable use and content#

You must follow our Acceptable Use Policy, which lists the content and practices that are not allowed — including the kinds of information that rule 3(1)(b) of the IT Rules says users must not host, display, upload, publish, transmit, store or share. You are responsible for the content you send and store using the Service.

If we become aware of content or activity that breaks the law or these Terms, we may remove or disable access to it, cancel scheduled notifications, pause sending, or suspend or terminate access, as described in that policy. Where we receive an order from a court or an authorised government agency, we act within the time the law sets. We will remind you of these rules at least once every three months, as the IT Rules require.

8. Your data and privacy#

  • You own Customer Data. You give us a limited, non-exclusive licence to host, copy, transmit, display and otherwise process it only to provide, secure and support the Service, to comply with the law and to enforce these Terms.
  • Processing terms. The Data Processing Addendum forms part of these Terms and governs how we process personal data in Customer Data.
  • Your account data. How we handle the personal data of account holders and website visitors is explained in our Privacy Policy.
  • Export. You can download your subscribers (with their tags), your notification history and daily statistics as CSV files from the dashboard at any time.
  • Deletion. You can delete individual subscribers, and whole apps with everything recorded for them, in the dashboard. To close your account or delete an organization, ask us as described in Suspension and termination.
  • Statistics. We may use aggregated figures about how the Service is used (for example, the total number of notifications sent) to run and improve it. These figures do not identify you or your subscribers.

9. Delivery services and other third parties#

Notifications reach devices through services run by others: Google Firebase Cloud Messaging (for Android, and for iOS through the Apple Push Notification service), and the push services built into web browsers (run by Google, Mozilla, Apple and Microsoft). Whether and when a notification appears also depends on the subscriber’s device and settings, such as Do Not Disturb, battery saving, notification permissions and whether the app is still installed.

We do not control these services, so we cannot guarantee that any notification will be delivered, displayed or delivered at a particular time. “Delivered” in your statistics means a delivery service accepted the message. Delivery services may limit, delay or reject messages under their own rules, and their terms apply to you as well.

The Service may link to third-party websites and tools. We are not responsible for their content or practices.

10. Availability, support and changes#

  • We work to keep the Service available and reliable, but unless we agree otherwise in writing, we do not promise any particular uptime. There is no service-level commitment on the free plan.
  • We may need to stop the Service briefly for maintenance. Where we can, we schedule planned maintenance outside Indian business hours and announce longer interruptions in advance.
  • Support is provided by email at support@pushix.in. We aim to reply within two working days.
  • We improve the Service continually and may add, change or remove features. If we remove a major feature of your paid plan during a period you have paid for, you may cancel and receive a refund for the unused part of that period.
  • Features marked as beta or preview are provided as they are and may change or end without notice.

11. Suspension and termination#

If you want to leave

You can stop using the Service at any time and delete your apps in the dashboard. To close your account or delete an organization, the organization’s owner can email us at info@pushix.in from the account’s email address. Deletion is permanent: data is removed from our live systems straight away and from backups within 30 days, except records we must keep by law (see the Privacy Policy). Export anything you need first.

When we may suspend

We may suspend or restrict an account or organization, including by pausing sending, if:

  • it seriously or repeatedly breaks these Terms or the Acceptable Use Policy;
  • its use puts the Service, other customers, subscribers or our standing with delivery services at risk (for example, high complaint rates, or credentials revoked by Apple or Google);
  • we must do so to comply with the law or with an order from a court or an authorised government agency;
  • an amount due remains unpaid after we have reminded you; or
  • we reasonably suspect the account has been compromised.

Where it is reasonable and lawful, we will tell you why and give you a chance to fix the problem first. While an organization is suspended, no notifications can be sent (including scheduled and automated ones) and no new subscribers are collected, but your data is kept. Contact us to resolve a suspension.

When we may terminate

We may end these Terms for you if you breach them in a serious way that you do not fix within 15 days of our notice, or immediately if you use the Service for something unlawful. We may also stop offering the Service altogether by giving at least 60 days’ notice, and we will refund the unused part of any prepaid period. Unless the law prevents it, or you used the Service unlawfully, we will give you at least 15 days to export your data before we delete it.

Sections that by their nature should continue after the Terms end — such as those on payment, intellectual property, liability, indemnity and disputes — continue to apply.

12. Intellectual property#

We and our licensors own the Service, including its software, SDKs, documentation, designs and the Pushix name and logo. While you use the Service, we give you a non-exclusive, non-transferable right to use the dashboard and API and to include our SDKs and plugin in your apps and websites so they can work with the Service. Where an SDK comes with its own licence, that licence applies to its code.

You must not copy, resell or rent the Service, remove our notices, or access it to build a competing product. If you send us feedback or suggestions, we may use them freely and without any obligation to you.

Your names, logos and content remain yours. We will not name you as a customer in public without your permission.

13. Security and confidentiality#

We protect the Service and Customer Data with the measures described in our Privacy Policy and Data Processing Addendum. You are responsible for securing your own devices, accounts, servers and the credentials you hold.

Each of us will keep the other’s non-public business information confidential, use it only for the purposes of these Terms, and protect it with reasonable care. This does not apply to information that is or becomes public through no fault of the receiving party, was already known to it, or must be disclosed by law.

If you find a security weakness in the Service, please report it to us privately (see the Contact page) and do not test it in a way that could harm the Service, its data or other customers.

14. Disclaimers#

To the extent the law allows, the Service is provided “as is” and “as available”, and we make no promises beyond those written in these Terms — including any implied promise of merchantability, fitness for a particular purpose, or uninterrupted or error-free operation. Nothing in these Terms takes away any right you have under the Consumer Protection Act, 2019 or any other law that cannot be excluded by contract.

15. Limitation of liability#

  1. Neither you nor we are liable for indirect, incidental, special or consequential losses, or for loss of profits, revenue, business, goodwill or anticipated savings, even if they were foreseeable.
  2. Our total liability for all claims relating to the Service in any 12-month period is limited to the greater of (a) the fees you paid us for the Service in the 12 months before the event giving rise to the claim, and (b) INR 5,000.
  3. These limits do not apply to liability for fraud, for death or personal injury caused by negligence, to your payment obligations or your indemnity below, or to any liability that the law does not allow to be limited.

16. Indemnity#

You will defend and indemnify us against claims, penalties and reasonable costs (including legal fees) brought by third parties or authorities that arise from the notifications and content you send, from not having the consent or giving the notice the law requires, from your apps and websites, or from your breach of these Terms or the law. We will tell you promptly about any such claim, let you control its defence, and cooperate reasonably. You may not settle a claim in a way that admits fault on our behalf without our consent.

17. Governing law and disputes#

  1. These Terms are governed by the laws of India.
  2. If you have a complaint, please contact our Grievance Officer, Sanjit Karmakar, at sanjit@pushix.in first. Most problems can be solved this way, and the response times are listed on our Contact page.
  3. Subject to the next point, the competent courts in West Bengal, India have exclusive jurisdiction over any dispute arising from these Terms or the Service.
  4. If you are a consumer under the Consumer Protection Act, 2019, nothing in these Terms stops you from approaching the consumer commission that has jurisdiction or the National Consumer Helpline.

18. Changes to these Terms#

We may update these Terms. We will publish the new version on this page with a new “Last updated” date. If a change materially affects your rights, we will tell you by email or in the dashboard at least 15 days before it takes effect — unless it is needed sooner to comply with the law or to keep the Service secure. If you continue to use the Service after a change takes effect, the new Terms apply. If you do not agree, stop using the Service and close your account; if you are on a paid plan and the change materially harms you, we will refund the unused part of your current period.

19. General#

  • Whole agreement. These Terms and the policies they include are the whole agreement between you and us about the Service. If we sign a separate written agreement with you, it takes priority. For the processing of personal data, the Data Processing Addendum takes priority over these Terms.
  • Transfer. You may not transfer your rights under these Terms without our written consent. We may transfer ours to a company that takes over the Service, and will tell you if we do.
  • Events beyond control. Neither of us is responsible for delays or failures caused by events beyond our reasonable control, such as failures of delivery services, internet or power outages, natural disasters, epidemics or government action.
  • Notices. We send notices to the email address of your account or show them in the dashboard. You can send notices to us using the details on our Contact page.
  • Other terms. If any part of these Terms cannot be enforced, the rest still applies. If we do not enforce a right straight away, we can still enforce it later. Nothing in these Terms creates a partnership, agency or employment relationship. These Terms are written in English; any translation is for convenience only.

20. Contact#
